Terms of Use
  1. Definitions

    "SurrealChat", "SurrealChat server", or "SurrealChat network" means any server or servers that are listed under the surrealchat.net domain name.

    "SurrealChat service" means any service we provide under the surrealchat.net or surrealnet.org domain names.

    "The Administrators" means anyone authorized by the owner of the SurrealChat network to act as an IRC Operator, or the owners themselves.

  2. Terms and Conditions of Use

    SurrealChat is a private IRC network; access to it is allowed only to users who understand and agree to follow this Acceptable Use Policy (AUP). If you do not agree to the terms of this AUP, disconnect from all SurrealChat servers immediately and discontinue all efforts to access or utilize any SurrealChat server or service.

    Your permission to access SurrealChat may be withdrawn at any time, temporarily or permanently, for any reason, and without warning or explanation.

    The Administrators are not responsible for the actions of IRC users. IRC is an unmoderated environment and you connect at your own risk.

    THE ADMINISTRATORS SHALL NOT HAVE ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE, ATTEMPT TO USE, OR INABILITY TO USE THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    Pursuant to United States Code (U.S.C.), Title 18, Part 1, Section 2701 Part (c), SurrealChat may scan your system to ensure it does not present a security risk to our network or its users. By connecting to any SurrealChat server, you consent to any and all scans, to be administered at the discretion of the Administrators.

    Attacks or viruses that deny service, hurt, impair, or otherwise cause damage to this network or its users are illegal via Title 18, U.S.C. Part 1, Chapter 47, Section 1030. They are also illegal via the Canadian Criminal Code s. 342.2.

    Accessing SurrealChat once specifically denied access is illegal. Violators may have their ISP or law enforcement notified. You understand that any suspected violation of this AUP or criminal acts may subject you to monitoring and disciplinary action by either the Administrators, your ISP, and/or law enforcement. The Administrators will cooperate fully with any ISP, proven law enforcement entity, or court order to aid in the apprehension of suspects.

    If any provision of this AUP is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms of this AUP, and without further action by the parties hereto, such provision shall be reformed to the minimum extent necessary to make such provision valid and enforceable.

Acceptable Use Policy

While using SurrealChat, you agree to abide by the following rules:

  1. You may not use any system to access SurrealChat without explicit permission from that system's owner. You will be assumed to be violating this rule if you use any system that can be accessed and controlled remotely without authorization, such as an open proxy or botnet system.

  2. You may not use SurrealChat to transfer information where you do not have the legal right to do so, or the information is illegal to possess in the United States. This includes, without limitation, copyrighted materials, child pornography, and malicious software.

  3. You may not use SurrealChat to coordinate or plan criminal activity.

  4. You may not use SurrealChat to make threats against any other user.

  5. You may not maintain more than 3 simultaneous connections to SurrealChat, even from different hosts.

  6. You may not send unrequested messages to users or channels by automated [or non-automated] means, This includes [without limitation] scripts, spambots and floods.

  7. All bots must be marked with umode +B and follow the rules in the BotMOTD.

  8. You must follow the Services AUP, below.

  9. The Administrators reserve the right to enforce or waive these rules, and they are subject to change without notice.

Services AUP
  1. No excessive nickname or channel registrations.

    Please LINK nicks instead of registering, and keep registered nicks limited to one per person or bot. Also, please UNLINK any nicks (registered or linked) that you no longer use, as a courtesy to others and to reduce load on our servers. Do not register more nicknames or channels than you can reasonably use. Do not register nicknames or channels only to keep others from using them. Use common sense.

    Nickname and channel registrations are logged and monitored for excess. If we determine that you have obtained an excess amount and you fail to drop some when asked, some or all of the nicks or channels may be dropped. If you persist in registering more, you may be banned.

  2. No flooding/spamming users via MemoServ.

  3. No using other people's nicks.

    You may not use any NickServ command on a nick that you did not personally register, and you may not intentionally give away your password(s).

  4. No flooding services.

    Any user found flooding services in any way will be removed from the network or banned at the staff's discretion.

  5. No selling or trading of nicknames or channels.

    SCnet provides its registration services to the user free of charge. Therefore, the selling or trading of nicknames or channels is, in effect, selling or trading those services. This will not be tolerated and will result in immediate loss of said nickname or channel.

  6. No impersonating services or opers.

    Impersonating opers or a services bot with the intent to confuse users is strictly forbidden.
